Terms of Service & End User License Agreement

Please read these Terms of Service and End User License Agreement ("Agreement" or "Terms") carefully before downloading, installing, or using Voxbrief ("Application", "App", "Service").

By downloading, installing, or using Voxbrief on your Apple iOS, watchOS, or macOS device, you agree to be bound by the terms and conditions set forth in this Agreement. If you do not agree to these terms, do not install or use the Application.

1. License Grant

We grant you a revocable, non-exclusive, non-transferable, limited license to download, install, and use the Application strictly in accordance with the terms of this Agreement and Apple's Media Services Terms and Conditions (including the Standard EULA applicable to App Store licensed applications).

2. Ownership of Content & Intellectual Property

Your Content Belongs to You: You retain 100% of all intellectual property, copyright, and ownership rights in and to any audio recordings, spoken memos, transcripts, summaries, specifications, tags, and structured notes created, captured, or stored using Voxbrief. We claim no ownership, license, or right of any kind over your data.

Application Rights: The Application's source code, visual design, user interface, brand name, and proprietary algorithms are protected by copyright, trademark, and other applicable intellectual property laws.

3. On-Device AI & Machine Learning Disclaimer

Voxbrief utilizes local on-device machine learning models to provide automatic speech recognition (ASR via WhisperKit) and natural language text restructuring (via native Apple FoundationModels and MLX Swift Qwen3):

  • Accuracy of Output: While the models are engineered to produce highly accurate transcriptions and structured Markdown summaries, artificial intelligence outputs are probabilistic and may occasionally produce transcription inaccuracies, omissions, or formatting discrepancies.
  • User Verification: You acknowledge that you are responsible for reviewing and validating all transcripts, requirement bullets, condition lists, and action items before relying on them for critical engineering, business, legal, medical, or financial purposes.
  • No Professional Advice: Notes generated by Voxbrief do not constitute formal legal, financial, or medical counsel.

4. User Responsibilities & Acceptable Use

You agree to use Voxbrief in compliance with all applicable local, state, national, and international laws and regulations. You are solely responsible for ensuring that your recording of any conversation or voice note complies with applicable wiretapping, eavesdropping, and consent laws (including one-party or all-party recording consent requirements in your jurisdiction).

5. Open Source Software & Third-Party Components

Voxbrief incorporates and builds upon open-source software libraries, each subject to their respective open-source licenses:

  • WhisperKit: Licensed under the MIT License by Argmax, Inc.
  • MLX & MLX Swift: Licensed under the MIT License by Apple Inc.
  • OpenAI Whisper: Model architecture and weights licensed under the MIT License.
  • Qwen3: Model architecture and weights licensed under the Apache 2.0 License.

6. Disclaimer of Warranties

THE APPLICATION IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APPLICATION WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF DEFECTS.

7. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER OR CONTRIBUTORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES RESULTING FROM YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APPLICATION.

8. Termination

This Agreement is effective until terminated by you or the developer. Your rights under this Agreement will terminate automatically without notice if you fail to comply with any term(s) of this Agreement. Upon termination, you must cease all use of the Application and delete all copies from your devices.

9. Governing Law

This Agreement and any disputes arising out of or related to it shall be governed by and construed in accordance with the laws of the United States and the State of California, without regard to its conflict of law principles.
